Chapter I General rules

Article 1 These Measures are formulated in accordance with the Supervision Law of the People's Republic of China for the purpose of deepening the reform of the State supervision system, giving full play to the advantages of the Central Commission for Discipline Inspection and the National Supervisory Commission in co-operating offices, promoting supervision organs to accept democratic supervision, social supervision and supervision by public opinion in accordance with the law, and standardizing the work of special supervisors.

Article 2 Special inspectors are public trust persons who are selected by the National Supervisory Commission according to the needs of their work and in accordance with certain procedures to perform supervision, consultation and other related duties in the form of part-time work.

Special inspectors are mainly selected from deputies to the National People's Congress, and may also be selected from members of the National Committee of the Chinese People's Political Consultative Conference, staff members of relevant departments of the central and state organs, members of democratic parties and personages without party affiliation, representatives of enterprises, public institutions and social organizations, experts and scholars, media and literary and artistic workers, as well as front-line deputies and grassroots people.

 We will give full play to the role of advisers, Bridges, and public opinion guidance.

Chapter II Recruitment, replacement and dismissal

Article 4 Special inspectors shall meet the following conditions:

(1) Adhere to the leadership of the Communist Party of China and support the Party's line, principles and policies, take the road of socialism with Chinese characteristics, abide by the Constitution, laws and regulations of the People's Republic of China, and be a citizen of the People's Republic of China;

(2) have high professional quality, have the corresponding professional knowledge and work ability to perform the duties, and have a certain representation and influence in their respective fields;

(3) Enthusiasm for comprehensively strict party governance, party conduct, clean government construction and anti-corruption work, have a strong sense of responsibility, earnestly perform their duties, and love the work of special inspectors;

(4) adhere to principles, seek truth from facts, maintain close ties with the masses, be fair and incorruptible, behave in a decent manner, and observe professional ethics and social ethics;

(5) Good health.

Article 5 Persons subject to Party disciplinary sanctions, administrative sanctions, criminal penalties, and other personnel who are not suitable to serve as special supervisors shall not be hired as special supervisors.

Article 6 The appointment of special inspectors shall be conducted by the State Supervisory Commission in accordance with the following procedures:

(1) According to the needs of the work, jointly with relevant departments and units to recommend candidates for special supervisors, and obtain the consent of the unit to which the recommended person belongs and the person himself;

(2) Jointly with relevant departments and units to investigate the candidates recommended by the special supervisors;

(3) The Central Commission for Discipline Inspection and the State Supervision Commission shall study the investigation situation and determine the candidates for hiring special supervisors;

(4) The list of candidates and opinions to be hired shall be copied to the unit where the special inspector is located and the recommended unit, and shall be recorded in the Organization Department of the Central Commission for Discipline Inspection and the State Supervision Commission;

(5) Hold recruitment meetings, issue letters of appointment, and publicize the list of special inspectors to the public.

Article 7 Special inspectors shall be replaced after the leading group of the National Supervisory Commission is formed, and each term of office shall be the same as that of the current leading group, and shall generally serve no more than two consecutive terms.

The special inspector shall be dismissed naturally upon expiration of his term of employment.

Article 8 If a special supervisor has any of the following circumstances, the National Supervisory Commission shall dismiss him or her through consultation with the recommending unit, and the recommending unit shall notify him or her in writing:

(1) receiving Party disciplinary sanctions, administrative sanctions, or criminal penalties;

(2) It is not suitable to continue to serve as a special inspector due to work adjustment, health conditions and other reasons;

(3) where he has applied for resignation as a special supervisor;

(4) failing to perform the duties and obligations of special inspectors for one consecutive year without justifiable reasons;

(5) There are other circumstances in which it is not appropriate to continue to serve as special inspectors.

Chapter III Duties, Rights and Obligations

Article 9 Special inspectors shall perform the following duties:

(1) To supervise the performance of duties by discipline inspection and supervision organs and their staff, and to put forward opinions and suggestions on strengthening and improving discipline inspection and supervision work;

(2) To provide advice on the formulation of laws and regulations on discipline inspection and supervision, the promulgation of major policies, the drafting of important documents, and the proposal of supervision;

(3) To participate in the investigation, research, supervision and inspection, and special work organized by the National Supervisory Commission;

(4) To publicize the principles, policies and effectiveness of discipline inspection and supervision;

(5) to handle other matters entrusted by the National Supervisory Commission.

Article 10 Special inspectors shall enjoy the following rights in the performance of their duties:

(1) To understand how the National Supervisory Commission and the supervisory commissions of provinces, autonomous regions and municipalities directly under the Central Government carry out their supervisory work and perform their supervisory duties, and to make comments, suggestions and criticisms;

(2) consult and obtain relevant documents and materials after applying for approval according to the requirements of performing duties and procedures;

(3) To participate in or attend relevant meetings organized by the National Supervisory Commission;

(4) To participate in relevant professional training organized by the National Supervisory Commission;

(5) To understand and reflect the situation of clean politics and employment in relevant industries and fields and the handling of opinions and suggestions;

(6) When entrusted by the National Supervisory Commission to carry out work, enjoy the statutory authority related to the entrusted work.

Article 11 Special inspectors shall perform the following obligations:

(1) abide by the Constitution and laws, keep state secrets and work secrets as well as business secrets and personal privacy acquired in the performance of duties, be honest and self-disciplined, and accept supervision;

(2) Learning and mastering relevant laws, regulations and business of discipline inspection and supervision;

(3) To participate in the activities organized by the National Supervisory Commission, abide by the relevant work rules of the National Supervisory Commission, and earnestly perform their duties in accordance with the prescribed limits of authority and procedures;

(d) in the process of performing the duties of special inspectors, when there is a conflict of interest, take the initiative to apply for withdrawal;

(5) Without the consent of the National Supervisory Commission, he may not make remarks, publish works, or participate in relevant social activities in his capacity as a special supervisor;

(6) He shall not seek any personal gain or privilege as a special inspector.

Chapter IV Guarantee of performance of duties

Article 12 The National Supervisory Commission shall provide necessary working conditions and convenience for the special inspectors to carry out supervision over the supervisory organs and their staff in accordance with law.

Article 13 The relevant expenses incurred by special supervisors in performing their duties as prescribed in these Measures shall be verified and reported by the National Supervisory Commission in accordance with regulations.

The funds required by the special supervisors to perform the duties prescribed in these measures shall be included in the scope of the operational funds guaranteed by the National Supervisory Commission.

Article 14 The office of the National Supervisory Commission responsible for the work of special inspectors shall be established in the General Office and perform the following functions:

(1) To coordinate the relevant work of the special inspectors, improve the working mechanism, formulate work plans, supervise and inspect the implementation of the working mechanism and plan of the special inspectors by the relevant departments of the National Supervisory Commission, and summarize and report on the annual work of the special inspectors;

(2) To organize the recruitment and dismissal of special supervisors;

(3) To organize special inspectors to participate in relevant meetings or activities, carry out regular visits, report work, exchange information, and listen to opinions and suggestions;

(4) to accept, transfer and supervise the opinions, suggestions and criticisms put forward by the special inspectors, and to give feedback;

(5) Coordinate relevant departments, provide relevant publications and materials to the special inspectors on a regular basis, and organize and carry out professional training for the special inspectors;

(6) to undertake the liaison and guidance of the work of special inspectors of supervisory organs, organize the exchange of experience, and strengthen and improve the work of special inspectors;

(7) Conduct dynamic management and assessment of special inspectors;

(8) Strengthen communication with the units where the special inspectors belong and recommended units, understand the work of the special inspectors, give feedback on the performance of the special inspectors, and solicit opinions and suggestions;

(9) Handle other related work.

Article 15 Special inspectors shall not leave their own posts, and their salaries, bonuses and welfare benefits shall be borne by the units they work for.

Chapter V Supplementary provisions

Article 16 The National Supervisory Commission shall be responsible for the interpretation of these measures.

Article 17 These Measures shall come into force on August 24, 2018. On October 10, 2013, the Work Measures for Specially invited Supervisors of Supervisory Organs promulgated by the former Ministry of Supervision shall be repealed simultaneously.
