Notice of the Ministry of Transport of the Certification and Accreditation Administration on the issuance of the "Management Measures for the Certification of Transportation One-Card Products (Trial)"

Chapter I General rules

Article 1 These Measures are formulated in accordance with the Regulations on Certification and Accreditation of the People's Republic of China and other laws and regulations in order to effectively strengthen the standard compliance, product consistency, safety and stability of traffic card products, ensure the consistency and compatibility of the national traffic card business system, regulate and manage related certification activities.

Article 2 The term "transportation card" as mentioned in these Measures refers to physical or virtual transportation cards, two-dimensional codes and other specific information carriers or media mainly used for payment or settlement in the field of transportation. The transportation card products include physical cards, mobile carriers or media, virtual media, as well as machine terminals for payment acceptance, commercial cryptographic equipment and various information processing systems.

Article 3 The National Certification and Accreditation Administration (hereinafter referred to as the CNCA) and the Ministry of Transport jointly organize and promote the work of transportation card product certification, manage and supervise the work of transportation card product certification according to the responsibilities of the department, and promote the acceptance of certification results.

Article 4 Organizations and personnel engaged in transportation card product certification activities shall have the obligation to keep confidential the trade secrets and technical secrets they know in their professional activities.

Article 5 The CNCA and the Ministry of Transport jointly establish a transportation card product certification technical committee, responsible for drafting the transportation card product certification catalog, certification rules draft, research and solve the technical problems in the implementation of transportation card product certification, and put forward suggestions on the transportation card product certification and credit. The Technical committee is responsible for the statistics of the relevant data on the acceptance of the certification results of the transportation card products, and reports to the Accreditation Administration and the Ministry of Transport.

Article 6 The certification catalogue of transportation card products shall be issued by the Certification and Accreditation Administration jointly with the Ministry of Transport.

Article 7 The certification rules of the traffic card product in the certification catalogue shall be issued by the Accreditation Administration, and shall be based on the officially issued national standards, industry standards and group standards.

Chapter II Qualifications of institutions and personnel

Article 8 A certification body engaged in transportation card product certification (hereinafter referred to as a card certification body) shall be established in accordance with the law, meet the general requirements of the national standards on the technical ability of product certification bodies, have the relevant inspection and testing technical ability to engage in transportation card product certification activities, subject to the approval of the Certification Administration, can engage in transportation card product certification activities.

Certification bodies apply to engage in transportation card certification business, business Ministry of Transport, approved by the Accreditation Administration.

Article 9 A card certification body shall follow the principles of fairness, openness, objectivity, independence, honesty and credit to maintain the social credit system.

The card certification body shall carry out product certification in accordance with the relevant national certification and accreditation laws and regulations, relevant standards and certification rules.

A card certification body should have a quality management system and internal audit system suitable for its certification business scope, and ensure effective implementation, and has a complete confidentiality management, project management, personnel management and training and education management system, and effective operation.

Article 10 Institutions engaged in transportation card product certification related inspection and testing activities shall be qualified according to law, have the professional ability to test products in the certification catalogue, and be signed by the certification authority approved by the Certification Administration.

Article 11 The certification body shall establish a sound management system for certification personnel, regularly train certification personnel, and ensure that their ability continues to meet the relevant requirements of the State on the professional qualifications of certification personnel.

Chapter III certification implementation

Article 12 The producer or seller of the product (hereinafter referred to as the certification client) shall entrust the card certification body to conduct the transportation card product certification, and provide the relevant technical materials to the card certification body in accordance with the provisions of the specific product certification rules.

The card certification body shall accept its certification authorization, and carry out certification activities in accordance with these measures and the transportation card product certification rules.

Article 13 After accepting the certification commission, the card certification body shall arrange product inspection and testing and factory inspection in accordance with the regulations of the transportation card product certification rules.

Article 14 A card certification body shall examine the authenticity of the samples provided by the certification client, and according to the characteristics and actual situation of the product, adopt the certification client to send samples, on-site sampling or on-site sample sealing by the client to send samples, etc., and entrust relevant qualified inspection and testing institutions to carry out product inspection and testing of the samples.

Article 15 The inspection and testing institution shall ensure the authenticity and accuracy of the inspection and testing results, and make a complete record of the whole process of inspection and testing, archive and retain, ensure the traceability of the inspection and testing process and results, and cooperate with the certification body to carry out effective follow-up inspection of the certified products.

Article 16 A card certification body completes product inspection and inspection and factory inspection, and issues a certification certificate to the certification client if it meets the certification requirements; If it does not meet the certification requirements, it shall notify the certification client in writing and explain the reasons.

The card certification body and its related personnel shall be responsible for the certification conclusions made by it.

Article 17 A card certification body shall disclose the relevant information such as the certification rules, charging standards, and product certification in accordance with the law.

Article 18 A card certification body shall not engage in the consultation, product development and sales of transportation card products.

Article 19 A card certification body shall, in accordance with the provisions of the certification rules, take an appropriate and reasonable way and frequency to implement effective follow-up inspection of the certified products and their manufacturers, control and verify that the certified products continue to meet the certification requirements.

For those who cannot meet the certification requirements, the card certification body shall suspend or revoke the certification certificate according to the relevant circumstances in accordance with law, and publish it.

Chapter IV Certification certificates and certification marks

Article 20 The certification certificate shall include the following basic contents:

(1) Name and address of the authenticating client;

(2) The name and address of the producer (manufacturer) of the product;

(3) Name and address of the production enterprise;

(4) Product name and product series, specifications/models;

(5) the basis for certification;

(6) Authentication mode;

(7) date of issuance and period of validity;

(8) license issuing organs;

(9) Certificate number;

(10) Other contents that need to be marked.

Article 21 The validity period of the transportation card product certification is 3 years. Within 3 months prior to the expiration of the validity of the certificate, the certified institution shall apply for re-certification in accordance with the provisions of the rules for the certification of traffic card products.

The card certification body shall, in accordance with the provisions of the certification rules, make a timely decision on the change, extension, cancellation, suspension or revocation of the certification certificate in accordance with different circumstances.

Article 23 The certification client who has obtained the transportation card product certification shall affix, print and mould the transportation card product certification mark on the certified product or the minimum sales package. Transportation card product certification marks can be printed on promotional materials such as advertisements and product introductions of certified products, and can be scaled up or down, but must not be deformed.

Article 24 The certification client who has obtained the transportation card product certification shall establish a management system for the use of certification certificates and certification marks.

The card certification body shall take effective measures to supervise the correct use of certification certificates and certification marks by the certification body.

Article 25 No organization or individual may forge, alter, fraudulently use, illegally trade or transfer the transportation card product certification certificate and certification mark.

Chapter V supervision and management

Article 26 The CNCA carries out regular or irregular supervision and inspection of the transportation card product certification body, finds violations of laws and regulations, investigates and deals with them according to law, and informs the Ministry of Transport.

Article 27 The local certification and accreditation supervision and administration departments shall, in accordance with their duties, supervise and inspect the certification activities of traffic card products within their jurisdiction according to law, and investigate and punish illegal acts. Local transport authorities in accordance with their duties, in accordance with relevant industrial policies, to promote the adoption of transport card product certification, promote the application of transport card certification products.

Article 28 If the certification client has objections to the certification activities and certification conclusions of the card certification body, it can make representations to the card certification body, and if it still has objections to the processing results of the card certification body, it can appeal to the Certification Administration.

Article 29 Any organization or individual has the right to report violations of laws and regulations in the certification activities of transportation card products to the Accreditation Administration, and the Accreditation Administration shall deal with them in a timely manner and keep confidential for the informants.

Chapter VI Supplementary Provisions

Article 30 The CNCA and the Ministry of Transport shall be responsible for the interpretation of these Measures within their respective responsibilities.

Article 31 These Measures shall go into effect as of the date of promulgation.
